By participating in the Thrive Beta Testing Program (“Beta Program”), you agree to the following Terms of Service (“Agreement”) between you (“User” or “Tester”) and the creators of Thrive (“we,” “us,” or “our”). If you do not agree, do not install or use the Thrive application (“App”).
1. Eligibility
Participation in the Beta Program is voluntary. You must be at least 18 years old and legally able to form a binding contract in your country of residence.
2. License & Restrictions
We grant you a non-transferable, non-exclusive, revocable license to use the Thrive App solely for personal, non-commercial evaluation purposes during the beta period.
You may not, and agree not to:
– Copy, distribute, or disclose any part of the App or its contents;
– Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or design of the App;
– Reuse, clone, or incorporate any ideas, features, designs, or functionality from the App into any other product or service;
– Use the App for any unlawful or unauthorized purpose.
3. Intellectual Property
All intellectual property rights in and to the App—including but not limited to its dynamic scheduling mechanism, smart stats, AI-driven insights, UI design, and underlying logic—are and shall remain the exclusive property of the creators of Thrive. No rights or licenses are granted to you except as expressly stated herein.
4. Confidentiality
While we do not require a separate non-disclosure agreement, you acknowledge that as a beta tester, you may have access to confidential and proprietary information. You agree not to disclose, share, or discuss any non-public aspects of the App or your testing experience without our written consent.
5. Feedback
You may submit feedback, suggestions, or ideas (“Feedback”) voluntarily. By doing so, you grant us an irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and incorporate your Feedback without restriction or obligation to you.
6. Data Collection
By participating in the Beta Program, you consent to the collection and use of certain data, including usage metrics, feedback, and device information. We handle all data in accordance with our [Privacy Policy] (link to be added). Data collected will be used for product improvement, diagnostics, and analytical purposes.
7. No Compensation
You will not be compensated for participating in the Beta Program. Participation is voluntary and for evaluation purposes only.
8. No Warranty
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the App will be error-free or that its features will function as intended.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE CREATORS OF THRIVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APP.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time for any reason. You may also stop using the App at any time. Upon termination, all licenses and rights granted to you will immediately cease.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Your Country or State]. Any disputes shall be resolved in the courts of [Your Jurisdiction].
12. Changes to Terms
We may update these terms from time to time. Continued participation in the Beta Program after changes means you accept the revised terms.
By installing or using the Thrive app as part of the Beta Program, you agree to these Terms of Service.
